Man Attacked, Robbed by Wendy's Employees
Two Wendy's employees have been convicted of battery and theft after robbing a patron of the Oak Park restaurant.
Larry Mitchell, the victim, claims that he was eating and counting his money when he was attacked by two men. One was wearing a coat over his uniform; the other had changed shirts. They sprayed him in the face with pepper spray and took his money. Each employee was sentenced to 6 days in jail and 1 year of probation. Now, Mitchell is suing the restaurant chain for negligent security and failure to train employees properly.
Generally, battery and robbery would be cause for a much more harsh sentence than the one the attackers received. They only stole a small amount of money, however, and so the charges were for petit theft and battery.
The lawsuit against Wendy's will use the police reports and the guilty plea of the two attackers as evidence. It is not reported how much Mitchell is seeking in damages.
