People of the State of Illinois v. IQ

Delivery of Cannabis to a Police Officer - NOT GUILTY

The Defendant was charged with Delivery of Cannabis to a police officer. According to the police the defendant delivered various amount of cannabis to undercover police officers during a three week period. It appeared that the police conducted a thorough investigation and had a strong case against the defendant. The Defendant was also on felony probation for a gun or unlawful use of a weapon charge and if he was convicted of the delivery of cannabis to a police officer his probation would be revoked and he would be sentenced to a term of imprisonment in the Illinois Department of Corrections.

The Defendant, not wanting to go to prison, hired Chicago Criminal Defense Attorney Michael P. Schmiege to represent him in his delivery of cannabis to police officer case. In the State of Illinois the charge of Delivery of Cannabis to a police officer of more than 2.5 grams but not more than 10 grams of any substance containing cannabis is a Class A misdemeanor that is punishable by up to one year in jail. As you can see this is a serious charge that needs to be handled by an experienced Chicago Criminal Defense Attorney. Mr. Schmiege reviewed the case file and the numerous police reports and developed a trial successful strategy. At trial the officer stumbled under a vigorous cross examination and the officer admitted that it had been months from the time that the alleged delivery of cannabis occurred and the arrest of the defendant and the fact that he had numerous encounters with individuals fitting the description of the defendant. At the end of the case Chicago Criminal Lawyer Michael P. Schmiege argued that the identification of the defendant as the individual selling the narcotics was questionable and that the State had failed to prove their case beyond a reasonable doubt.

The judge agreed with Chicago Criminal Lawyer Michael P. Schmiege and found the defendant NOT GUILTY of Delivery of Cannabis to a Police Officer. By hiring an experienced Chicago Criminal Defense Attorney the defendant avoided a potential jail sentence and a prison sentence on his violation of probation.
